Terms of Use

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. Additionally, accessing PharmLaw material through paid login is for you alone. Sharing of password and/or login information to others is strictly prohibited, will be considered a breach of the Terms and will subject the user to account cancellation without refund.

 

Intellectual Property

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of PHARMLAW LLC. PharmLaw is an entirely online course; no content may be downloaded, printed, or shared in any capacity. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Account Access

Your access to your PharmLaw account is valid for 90 days from the date of purchase or until you have obtained pharmacist licensure in the same state for which you purchased PharmLaw access. Any purchase of a second state as part of a combination offer must be activated concurrently with the original state purchase and is not intended to be held for future use. PHARMLAW LLC may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time, but refunds will only be issued according to the Refund Policy section below. Notwithstanding anything to the contrary in the foregoing, with respect to subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment and the same is nonrefundable. PHARMLAW LLC reserves the right to immediately cancel any account found in breach of these Terms, including but not limited to, login sharing between multiple people for which no refund will be given. 

Indemnification

You agree to indemnify and hold PHARMLAW LLC harmless from any demands, loss, liability, claims or expenses (including attorney fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website. 

Limitation of liability

To the maximum extent permitted by applicable law, under no event shall PHARMLAW LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.  To the maximum extent permitted by applicable law, PHARMLAW LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review the Terms and Conditions Page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and requests for feedback from us by email. If you don't want to receive such promotional materials or notices – please just notify us at any time at [email protected]

Refund Policy

We sincerely hope that you are satisfied with your purchase of access to PharmLaw, and we are confident that the PharmLaw content will prepare you for a successful MPJE®. However, in the event that you do not pass the MPJE® after diligently using PharmLaw’s material, we willingly offer you a full refund according to the timelines set forth in this paragraph. In order to receive the refund, you must send an email to [email protected] with a screenshot of your online MPJE® results page. This screenshot must show your name on the official NABP® site or letter, matching the name used for your PharmLaw access. This screenshot must also show the exam was for the same state as your PharmLaw access. In addition, if you have purchased PharmLaw access to multiple states, you will only be refunded for the amount you paid for the state in which you failed the exam. To be eligible for a refund, the refund request must be submitted to PharmLaw within 30 days of your MPJE® test date, and your MPJE® test date must be within the same timeframe of your PharmLaw access. Under no circumstances will PharmLaw issue a refund after 30 days from the date that your PharmLaw access expires. Please allow up to 10 days for processing of the refund. 

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the State of Oklahoma, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Cleveland County District Court, State of Oklahoma. Submitting a credit/debit card chargeback after having accessed PharmLaw content in any capacity, is a violation of these Terms of Use. This will result in immediate forfeiture of PharmLaw access and will be fully disputed with supporting documentation with PharmLaw’s legal representation. In addition, PharmLaw may contact the applicable Board of Pharmacy to discuss potential Unprofessional Conduct of the pharmacist. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

You further agree that prior to bringing a lawsuit of any type, you or your legal representative with contact PHARMLAW LLC and attempt mediation with a private party attorney mediator prior to the initiation of the lawsuit. The mediator shall not be affiliated with either party and shall serve as a neutral. You and PHARMLAW LLC agree to equally share the costs of said mediation subject to reallocation by the Court and/or further agreement between You and PHARMLAW LLC. The mediation shall occur within sixty (60) days notice of a potential claim or grievance except for good cause shown. PHARMLAW LLC reserves the right to reject mediation after notice of a claim or grievance should they find the same to be without merit. Upon written notice that PHARMLAW LLC is rejecting mediation, a lawsuit may be initiated.  By accepting these terms and conditions, you agree that failure to attempt mediation prior to bringing a lawsuit shall be immediate grounds for a dismissal of the lawsuit and PHARMLAW LLC shall be entitled to their attorney fees for the same.
